Wishwell Inc. ("Wishwell," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. 1. Who This Policy Covers

This Policy applies to:

  • Clients — couples, families, and individuals who inquire about or book our photography and videography services.

  • Website visitors — anyone who browses or interacts with our website.

  • Associates and contractors — the photographers, videographers, and other independent contractors who receive work opportunities through Wishwell, including through our Associate Dispatch System.

  • Vendors and partners — third parties we coordinate with to deliver events.

2. Information We Collect

We collect information in a few different ways:

Information you provide directly. This may include your name, email address, phone number, mailing or business address, event details, payment and billing information, insurance documentation, communications you send us, and any other information you choose to share.

Information collected automatically. When you visit our website, we may automatically collect certain technical information such as your IP address, browser type, device information, pages viewed, and how you interact with our site. We may use cookies and similar technologies to do this (see Section 7).

Information from third parties. We may receive information about you from service providers, referral sources, payment processors, or publicly available sources, consistent with applicable law.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve our Services;

  • Respond to inquiries and communicate with you about bookings, events, and assignments;

  • Coordinate staffing and dispatch work opportunities to our associates (see Section 6);

  • Process payments and manage invoicing;

  • Maintain records, including insurance and contractor compliance documentation;

  • Send administrative, transactional, and operational messages;

  • Protect the security and integrity of our Services;

  • Comply with legal obligations and enforce our agreements.

We do not sell your personal information.

4. How We Share Your Information

We share personal information only as needed to run our business, including with:

  • Service providers and processors who perform functions on our behalf — such as messaging platforms, email delivery providers, payment processors, cloud storage, and scheduling tools. These providers are permitted to use your information only to perform services for us.

  • Clients, associates, and vendors as necessary to coordinate and deliver an event (for example, sharing a lead photographer's contact information with a second shooter assigned to the same event).

  • Legal and safety purposes — when required by law, subpoena, or legal process, or to protect the rights, property, or safety of Wishwell, our clients, our associates, or others.

  • Business transfers — in connection with a merger, acquisition, financing, or sale of assets.

We do not sell or rent your personal information to third parties for their own marketing purposes.

5. Third-Party Services We Use

To operate our Services, we rely on trusted third-party providers, which may include (but are not limited to) messaging and communications platforms, email delivery services, payment and invoicing platforms, cloud file-storage services, website hosting, and analytics tools. Each provider maintains its own privacy practices, and we encourage you to review their policies. We share only the information necessary for these providers to perform their functions.

6. Associate Dispatch System (ADS)

Wishwell operates an Associate Dispatch System ("ADS") — an internal platform we use to offer jobs to, and communicate with, the independent photographers, videographers, and other associates who work with us on a contract basis. This section describes how the ADS handles associate information.

Information collected through the ADS. When you join our associate roster, we collect and maintain information such as your name, email address, mobile phone number, business details, availability, assignment and job history, communication preferences, and payment/invoicing information.

How we use ADS information. We use this information solely for operational and staffing purposes, including to offer you jobs, confirm assignments, share event details and timeline updates, coordinate logistics, and manage payment. We do not use ADS contact information for third-party marketing, and we do not sell it.

SMS / text-message notifications. With your consent, the ADS sends SMS text messages to associates regarding job offers, assignment confirmations, and updates for events you have opted in to. By providing your mobile number and agreeing to receive text messages — verbally during onboarding and/or in writing through our onboarding materials — you consent to receive these operational text messages from Wishwell.

  • Message frequency varies based on job activity.

  • Message and data rates may apply.

  • You may opt out of text messages at any time by replying STOP. For help, reply HELP.

  • Opting out of SMS may limit our ability to notify you of available work through text; you may continue to receive job information by other means (such as email or the vendor portal).

Email notifications. The ADS also sends operational emails (such as job offers and event updates) to the email address on file for your associate account.

Mobile information sharing. No mobile information collected through the ADS — including your phone number and consent to receive text messages — will be shared with or sold to third parties or affiliates for their marketing or promotional purposes. Phone numbers and SMS consent information are used only to deliver the messaging services described above, and are shared only with the messaging providers that transmit those messages on our behalf.

Retention. We retain associate information for as long as you remain on our roster and as needed to comply with our legal, tax, and recordkeeping obligations.

7. Cookies and Tracking Technologies

Our website may use cookies and similar technologies to remember your preferences, understand how our site is used, and improve your experience. You can usually adjust your browser settings to refuse cookies, though some features of our site may not function properly as a result. Where required by law, we will request your consent before placing non-essential cookies.

8. Data Retention

We keep personal information only for as long as necessary to fulfill the purposes described in this Policy, including to provide our Services, comply with our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

9. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, or misuse. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal information, including the right to:

  • Request access to the personal information we hold about you;

  • Request correction of inaccurate information;

  • Request deletion of your information;

  • Opt out of certain uses or disclosures;

  • Not be discriminated against for exercising your rights.

If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) provides additional rights, including the right to know what personal information we collect, use, and disclose; the right to request deletion or correction; and the right to opt out of the "sale" or "sharing" of personal information. Wishwell does not sell personal information. To exercise any of these rights, contact us using the information in Section 14.

We will respond to verifiable requests as required by applicable law. We may need to verify your identity before fulfilling certain requests.

11. Third-Party Links

Our Services may contain links to third-party websites or services that we do not control. This Policy does not apply to those third parties, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.

12. Children's Privacy

Our Services are not directed to children under the age of 13 (or the minimum age required in your jurisdiction), and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate, provide additional notice. Your continued use of our Services after any update constitutes your acceptance of the revised Policy.
